Terms of Service

These Terms form a contract between you and Konit, LLC for your Dublo account and the Dublo learning service. Your mandatory consumer rights in the country where you live are not limited by these Terms.

1. Who we are

Dublo is a language-learning service provided by Konit, LLC, a Delaware limited liability company ("Konit", "Dublo", "we", "us" or "our"). Our mailing address is 131 Continental Dr, Suite 305, Newark, Delaware 19713, USA. You can contact us at support@dublolearn.app.

Mobile applications may be distributed through Apple App Store or Google Play by the developer identified on the applicable store listing. Store terms also apply to the download, installation and any purchase made through that store. Konit provides the Dublo account and learning service described in these Terms.

2. Accepting these Terms

You accept these Terms when you affirmatively agree during account creation or checkout, or when an existing account accepts an updated version. If you do not agree, do not create an account or use the service. You must be legally capable of entering a contract. Dublo is not for children under 13. If you are 13 but below the age of legal majority where you live, a parent or legal guardian must review and approve these Terms and supervise your use.

3. The service

Dublo provides self-directed Thai-language lessons, audio, practice, progress tracking and related educational features. It is an educational aid, not accredited instruction, translation, emergency communication, professional advice or a substitute for a qualified interpreter. Pronunciation, vocabulary and appropriate usage can vary by region, speaker and context. Verify important communications independently.

No advertisement, placement result, course statistic, testimonial or feature description guarantees fluency, comprehension by another person, a particular score, employment, immigration outcome or progress within a fixed time. Results vary with prior knowledge, practice, ability and real-world use. We may improve, replace or discontinue features, but we will not remove paid access in a way that overrides mandatory law.

4. Accounts

• Provide accurate information and keep access to your sign-in method secure.
• You are responsible for activity under your account unless it results from our security failure.
• One account is for one learner and may not be sold, transferred or shared commercially.
• You may delete your account from Settings. Deleting an account does not automatically cancel a store subscription, so cancel it with the applicable billing provider first.

5. Free access and paid plans

Some lessons are free. Paid plans unlock additional content for the period shown before checkout. Available plans, prices, taxes, billing intervals and any trial are displayed before you confirm a purchase. We may change prices prospectively. A price change does not alter an already-paid period and will be communicated as required before a renewal.

6. Web subscriptions and automatic renewal

Web purchases are sold by Konit and processed by Stripe. Monthly, three-month and annual subscriptions renew automatically at the price and interval shown at checkout until cancelled. If an annual plan includes a trial, the trial length and first charge date are shown before confirmation. Unless mandatory law provides otherwise, cancelling stops future renewals and paid access continues through the end of the current period.

You can cancel or manage a web subscription through the billing portal in Dublo or by contacting support. Instructions and refund terms are in our Refund & Cancellation Policy. Our voluntary 14-day refund promise applies to your first web payment and can be used once per person and per account; statutory withdrawal and refund rights are unaffected.

7. App Store and Google Play purchases

Apple or Google processes purchases made through its store. Store subscriptions renew under the price, period and cancellation rules shown by that store. Manage cancellation and request a store refund through the relevant store account. Store terms control where they conflict with these Terms regarding store billing.

8. Promotions and affiliate referrals

A promotion or affiliate discount may have additional eligibility, duration and redemption rules. Only one valid offer may apply unless stated otherwise. An affiliate may receive a commission when you use their referral link or code. That commercial relationship does not increase the price shown to you, and any affiliate-funded discount is displayed before payment.

9. Tutor lessons (marketplace)

Live lessons are for adults. The Dublo course is available from age 13 under Section 2, but a live lesson is a private one-to-one video call with an independent adult tutor, and you must be 18 or over to book or take one. You confirm your age before your first booking, and we may cancel a lesson and close access to lessons if we learn that a booker is under 18. Tutors are told the same rule and must stop a lesson and report it to us if they believe the student is a minor.

Dublo may offer live one-to-one lessons with independent Thai tutors. Tutors are independent contractors, not employees or agents of Konit: they set their own prices, teach in their own name and are solely responsible for the tuition they deliver. Konit provides the marketplace around them — profiles, scheduling, payment processing and the online lesson room — and is not itself the provider of tuition.

Lesson fees are separate from subscription plans, are shown in full before you book, and are charged per lesson through our payment provider. The price shown on a tutor's profile is the price you pay; it includes Konit's margin and is set by us, not by the tutor. Booking, rescheduling, cancellation and refunds for lessons are governed by our Refund & Cancellation Policy. The acceptable-use rules in Section 10 apply inside lessons; lessons may not be recorded by either side without the other's consent. If a dispute arises between you and a tutor, contact support@dublolearn.app and we will try to help resolve it, including through the remedies in the Refund & Cancellation Policy.

Lesson credit. Lesson credit is a Premium benefit, from both ends: while your Premium subscription is active, part of what you pay for a lesson comes back to you as lesson credit, and credit is spendable only while that subscription is active. Credit is a reward balance, not money: it can only be spent on lessons in Dublo, cannot be exchanged for cash, transferred to another account or withdrawn, and has no cash value. Applying it is your choice, not automatic — you tick a box when booking, and only once your balance reaches $10, so small amounts can be saved up rather than trickled away. A lesson you pay for using lesson credit earns no new credit, and lessons booked while you are not a Premium subscriber neither earn credit nor can be paid with it. Credit does not expire while your account is open: if your Premium subscription ends, your balance is held and becomes spendable again if you resubscribe. If a booking that earned credit is refunded, the credit earned on it is removed; if a booking paid partly with credit is refunded, the credit part returns to your balance and only the card part returns to your card. We may end or change the credit reward for future bookings with notice. If you take a refund of the subscription payment that made you Premium, the benefits you have already used are deducted from that refund and any unspent credit is cancelled, as set out in Section 3 of the Refund & Cancellation Policy.

Free trial lesson. Some tutors choose to offer a free trial lesson; they are marked as such and shown first in the directory. If you are a Premium subscriber you may book one free 50-minute trial lesson in total across all tutors, once per account. The normal cancellation rules apply to it; if it is cancelled with a refund, your trial entitlement is restored. Without a Premium subscription the same lesson is available at the listed price. The trial is a promotional benefit, not part of the paid subscription, and we may change or withdraw it for future bookings. Because it has a real cash value — the tutor teaches it unpaid — a trial lesson you have taken is deducted from any refund of your subscription payment, at the list price shown on that tutor's profile.

10. Acceptable use

You may use Dublo only for personal, lawful learning. You must not:

• copy, scrape, record, republish, sell or systematically extract course content;
• share paid access, bypass entitlement checks or interfere with security;
• reverse engineer the service except where applicable law expressly permits it;
• upload malicious code, automate abusive requests or disrupt other users;
• use Dublo or its content to infringe rights or violate law.

11. Intellectual property

Dublo, its software, lessons, recordings, designs and branding are owned by Konit or used under licence from our licensors. We give you a limited, revocable, non-exclusive, non-transferable licence to use the service for personal learning during your permitted access. No ownership is transferred to you.

12. Feedback

If you voluntarily send a correction, suggestion or other feedback, you allow us to use it without payment or confidentiality obligation. This does not transfer ownership of your pre-existing material.

13. Suspension and termination

We may restrict or terminate access for fraud, chargebacks, serious or repeated breaches, security threats or legal requirements. Where practical, we will give notice and a chance to correct the issue. You remain entitled to remedies required by law.

Reporting, decisions and appeal. Anyone — with or without a Dublo account, and whether or not they are personally affected — can report a tutor profile, something that happened in a lesson, or any other content they believe is unlawful or breaches these Terms. How to do that, what we do with a report and how long it takes are set out on our Report content page. If we act against you as a result — restricting, pausing or removing your content, your tutor profile or your account — we tell you what we did, the reason, the rule it relied on, and whether the decision followed a report, our own checks or a legal requirement. You can contest that decision by replying to it; a person not involved in the original decision reviews it, and we reverse it if it was wrong. None of this replaces your right to go to a court or a competent authority.

14. Third-party platforms and Protected Parties

Apple, Google, Stripe, authentication providers and other third-party services have their own terms and controls. We are not responsible for their independent acts, outages, account decisions or payment processing, but this does not limit responsibility that applicable law places directly on us.

For Sections 13 through 19, "Protected Parties" means Konit and its affiliates, app distributors and publishers, licensors, contractors, service providers, officers, directors, employees and agents. Protected Parties may enforce the protections expressly granted to them in those Sections as intended third-party beneficiaries. No Protected Party is authorised to make a promise on Konit's behalf unless Konit confirms it in writing.

15. Availability, security and disclaimers

We use reasonable care in operating Dublo, but internet, device and software services may be interrupted, delayed, changed or contain errors. You are responsible for maintaining a compatible device, connectivity and backups of information you independently need.

To the maximum extent permitted by law, Dublo and all content are provided "as is" and "as available", and the Protected Parties disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and uninterrupted or error-free operation. Nothing here excludes statutory guarantees or digital-service rights that cannot lawfully be excluded.

16. Your responsibility and indemnity

You are responsible for losses caused by your unlawful commercial exploitation of Dublo, infringement of third-party rights, malicious interference, credential sharing, fraud or material breach of Section 10. To the extent permitted by law, you will defend and reimburse the Protected Parties against third-party claims and reasonable costs arising directly from that conduct. This does not apply to ordinary personal use, to losses caused by a Protected Party, or where consumer law prohibits it.

17. Limitation of liability

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot legally be limited. Subject to that rule, the Protected Parties are not liable for indirect, incidental, special, punitive or consequential loss, lost profits, lost opportunity or loss of data, to the extent such loss may lawfully be excluded.

For all claims that may legally be limited, the combined aggregate liability of the Protected Parties is limited to the amount you paid to Konit for Dublo during the 12 months before the event giving rise to the claim. If you paid nothing, the cap is USD 50. Some jurisdictions do not allow particular exclusions or caps, so those provisions apply only to the extent permitted there.

18. Privacy and cookies

Our Privacy Policy explains how we handle personal data. Our Cookie Notice explains browser storage, analytics and advertising technologies and how to control them.

19. Changes to these Terms

We may update these Terms for legal, security or service changes. Material changes will be notified in a reasonable manner before they take effect. Continuing to use the service after the effective date means you accept the updated Terms, except where fresh express consent is legally required.

21. Governing law and non-US disputes

These Terms are governed by Delaware law, without regard to conflict-of-law rules. For disputes not subject to Section 20, courts located in Delaware have non-exclusive jurisdiction. If you are a consumer, these clauses do not remove mandatory protections, statutory limitation periods or access to a court or regulator available under the law where you live.

22. Time to bring claims

To the extent permitted by law, a claim must be filed within one year after it arose; otherwise it is permanently barred. This does not shorten a mandatory statutory period available to a consumer.

23. General

Neither party is liable for delay caused by events reasonably beyond its control, except payment obligations. If part of these Terms is unenforceable, it will be narrowed to the minimum extent necessary and the rest remains effective. A delay in enforcing a right is not a waiver. These Terms do not create employment, partnership, agency or fiduciary duties. You may not transfer this agreement without our consent; we may transfer it as part of a merger, reorganisation, financing or sale of the service, provided mandatory rights are preserved. You must not use Dublo in violation of applicable export-control or sanctions laws.
